Below are the definitions under French law that may help you make this choice. It is your responsibility to verify and comply with the applicable regulations of the relevant countries when selecting the type of email, if applicable.
WhatsApp Marketing: communications intended to promote the products, services, or image of a company or organization to end consumers or distributors via SMS. These communications must include a way to unsubscribe, such as the message: STOP SMS.
Examples:
- Sales prospecting promoting a product;
- Promotional offers.
WhatsApp Service Messages: these are service information campaigns that do not require an opt-out option.
Examples:
- Purchase confirmation;
- Confirmation or modification of the details of a booking made (change of seat number on a train);
- Sending a verification code (two-factor authentication, packages, etc.).
There are 6 different legal bases justifying the processing of an individual’s data:
- Consent: the data subject has consented to the processing of their data
- Contract: processing is necessary for the performance or preparation of a contract with the data subject
- Legitimate interest: processing is necessary for the purposes of the legitimate interests pursued by the data controller or a third party, subject to the rights and interests of the data subjects
- Legal obligation: processing is required by law
- Public interest mission: The processing is necessary for the performance of a public interest mission
- Protection of vital interests: processing is necessary to protect the vital interests of the data subject or of a third party
