When creating a campaign, you will be asked to choose the type of SMS for your SMS campaign: Marketing or Service.
You will find below the definitions applicable under French law that can help you make this choice. It is your responsibility to check and comply with the applicable regulations of the countries concerned when choosing the type of email where applicable.
SMS Marketing : communication designed to promote the products, services or image of a company or organization to end consumers or distributors via SMS. These communications require a means of unsubscribing, for example the mention: STOP SMS.
Examples:
- Sales prospecting promoting a product;
- Promotional offers.
Service SMS: these are service information campaigns, which do not require a means of unsubscribing.
Examples:
- Purchase confirmation;
- Confirmation or change of the characteristics of a reservation made (change of seat number on a train);
- Sending verification code (double authentication, packages ...).
There are 6 different legal bases justifying the processing of individual data:
- Consent: the data subject has consented to the processing of his or her data
- Contract: the processing is necessary for the performance or preparation of a contract with the data subject
- Legitimate interest: processing is necessary for the pursuit of legitimate interests of the organization processing the data or of a third party, in strict compliance with the rights and interests of the individuals whose data is processed
- Legal obligation: processing is imposed by legal texts
- Mission of public interest: the processing is necessary for the performance of a mission of public interest
- Safeguarding vital interests: the processing is necessary to safeguard the vital interests of the data subject, or of a third party
